Terms and conditions

The present Legal Notice (hereinafter, the “Legal Notice”) sets forth the terms and conditions that govern the use of the Website by users. By using the Website, the user agrees to be bound by the Legal Notice.

The access to the Website is free, except from the costs of the internet connection services provided by the telecommunications company hired by the user.

ZHILABS reserves the right to modify and update the Legal Notice, as well as the Website contents, at any time and without prior notice. Therefore, we recommend reading the Legal Notice before using the Website.

In addition, the user shall refrain from using the content and information of any kind obtained through the Website with fraudulent purposes, to send advertising, communications for direct sale or for any other commercial purpose or unsolicited messages addressed to a plurality of people regardless of their purpose. It will also refrain from marketing or otherwise disclosing such information, as well as from carrying out any actions that might mislead our clients or damage the reputation, interests and rights of ZHILABS or any other third-party.

In particular, the user commits not to: delete, circumvent or manipulate the copyright and the other identifiers of the property rights of the Website’s contents, as well as the technical protection mechanisms or any other information mechanism that such contents may include. In the event that the user infringes the Legal Notice or where there is a reasonable suspicion that he or she is not complying with it, ZHILABS reserves the right to limit, suspend or terminate his or her access to the Website, adopting any technical measure necessary for that purpose. Furthermore, ZHILABS reserves the faculty to decide, in any moment, about the continuity of the services provided through the Website.

Limitation of liability

The purpose of the Legal Notice is exclusively informative. The user acknowledges and accepts that by using the Website, he or she undertakes all risks derived from it. Therefore, ZHILABS would not be liable for information not produced by it or published on its behalf in a manner not authorized by it, as well as any liability arising from the misuse by users or third parties of the Website’s contents. To that effect, ZHILABS would only be liable for the damages the user might suffer due to the use of the Website, when those damages were caused by ZHILABS’ willful misconduct.

In particular, ZHILABS would not by liable for:

Damages of any kind that may arise from interruptions in the availability of the Website, due to malfunctioning of the web server or applications, communications infrastructures, or software and hardware used for navigation.
The content of other websites linked to the Website. In this regard, the terms envisaged in the section “Policy to link to the Website” apply.
Damages of any kind originated in user’s terminals due to virus, worms, Trojans or any other harmful element. The user acknowledges that using Internet implies the assumption of the risk that its terminals may be affected by the elements listed before. In this sense, it is the user’s responsibility to have adequate tools so as to detect and remove harmful programs.

Intellectual and industrial property

The whole of the Website is protected by the laws on Intellectual and Industrial property. Unless otherwise indicated, the intellectual property rights over these contents correspond exclusively to ZHILABS or it has, where appropriate, the corresponding license to use and exploit them in place.

The user acknowledges that the use of the contents is strictly limited to the user’s personal purposes and that the reproduction, distribution, communication or transformation not expressly authorized of such works constitutes an infringement of intellectual property rights. It is expressly forbidden to reproduce elements or contents of the Website with commercial purposes or seeking profit.

The use of the Website by the user does not imply, in any way, the transfer of any intellectual property rights over the Website, its contents and/or ZHILABS’ distinctive symbols. To that effect, it is expressly forbidden to reproduce, transform, distribute, communicate, make available, extract or reuse the Website, its contents and/or ZHILABS’ distinctive symbols, except when legally permitted.

The Website includes or might include links that allow users to access other websites and Internet portals (hereinafter, the “Linked Sites”). In such cases, ZHILABS shall be deemed as an intermediary services provider, pursuant to Article 17 LSSI and would only be liable for the Linked Sites’ contents and services to the extent it has real knowledge about their unlawfulness and it has not diligently disabled the link. If a user considers that there is a Linked Site with unlawful or inappropriate contents, please report it to ZHILABS at info@zhilabs.com. This communication does not entail the obligation of ZHILABS to delete the corresponding link.

The existence of Linked Sites does not by any means imply that ZHILABS has an effective or any kind of knowledge about the services and contents of such sites nor that it has entered into agreements with the Linked Site’s owners. Neither does it entail any recommendation, promotion, recognition or conformity by ZHILABS with regard to the Linked Sites’ representations, contents or services.
